Captio End User License Agreement

1. Who this agreement is with

This agreement is between you and RehakIT vl. Bruno Řehak (RehakNet), Vinka Rehaka 17, 34550 Pakrac, Croatia ("we", "us") and covers the Captio software. Your payment is a separate contract with Lemon Squeezy (see section 10).

2. License

When you buy Captio you receive a non-exclusive, non-transferable license, identified by a license key, to install and use Captio on up to three computers that you own or control, for personal or business use, for as long as you like. You can free an activation at any time with Remove license from this PC in the About window. The license includes all updates and future versions of Captio, including version 2 and later, at no extra cost. Captio is licensed, not sold: we keep all rights that this agreement does not give you.

3. Your recordings and results

The transcripts and subtitles you create with Captio belong to you. You are responsible for having the right to transcribe the recordings you use, and for respecting the privacy and other rights of the people in them.

4. What Captio does and what it sends

Captio turns the speech in your audio and video files into subtitles and text. It runs on your computer and your files are never uploaded. Captio uses the internet only (a) to activate your key and to re-check it about once a day, which sends your license key and a random device label to the license service (Lemon Squeezy), and (b) if you choose to download an additional speech model. If you are offline or the service cannot be reached, Captio keeps working. More detail is in our privacy notice.

5. Accuracy

Speech recognition is not perfect. Always check the results before you rely on them.

6. Warranty and liability

Apart from the rights you have under mandatory law, Captio is provided "as is" and we give no warranty that it is error-free. To the extent the law allows, we are not liable for loss or damage arising from the use of Captio. Nothing in this agreement limits your mandatory legal rights as a consumer, including your rights if Captio is defective or not as described, or our liability for intent, gross negligence, or death or personal injury.

7. Third-party software

Captio includes FFmpeg (LGPL v3), whisper.cpp, Whisper.net and OpenAI Whisper models (MIT), and other open-source components. They stay under their own licenses, which are listed in THIRD-PARTY-NOTICES.txt in the installation folder and in the About window. Nothing in this agreement limits your rights under those licenses.

8. Restrictions

Do not copy, resell or redistribute Captio or your license key, do not use your key on more computers than the activation limit allows, and do not remove or bypass the license check. This does not restrict anything the law lets you do, for example making a backup copy.

9. Ending the license

We may end your license if you seriously break this agreement, for example by sharing your key beyond the activation limit or bypassing the license check. Your license also ends if your purchase is refunded or charged back, or your key is cancelled. In each case Captio will stop working after its next successful license check.

10. Purchase and refunds

Your purchase is processed by Lemon Squeezy, which acts as the seller of record; its terms apply to payment and tax. If you have not activated your license, you can ask for a refund within 14 days of purchase. Once you have activated your license you have started to use the software, and we do not offer refunds as a rule. If you have a problem or a reason for a refund, contact us at support@rehaknet.com and we will review your request case by case. Refunds are issued through Lemon Squeezy. This does not affect your legal rights, for example if Captio is defective or not as described. See also the refund policy.

11. License service

Captio relies on a third-party service for key checks. If that service is changed or discontinued, RehakIT vl. Bruno Řehak will make reasonable efforts to make sure you can keep using the version of Captio you bought, but cannot promise that this will always be possible.

12. Changes to this agreement

We may update this agreement for new versions of Captio. New terms apply to versions you install after the change and do not take away rights you already have.

13. Governing law

Croatian law applies to this agreement. If you are a consumer, you keep the protection of the mandatory law of the country where you live, and you may bring a claim in the courts of that country. Otherwise the competent courts of Croatia decide any dispute.

14. General

If a part of this agreement is invalid, the rest stays valid. This agreement is the whole agreement between you and us about Captio.
